1. TERMS AND DEFINITIONS

Personal Data – any information relating to an identified or identifiable natural person (the data subject), directly or indirectly. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, or online identifier.

Processing – any operation or set of operations performed on Personal Data, whether or not by automated means, including collection, recording, systematisation, structuring, accumulation, storage, rectification, retrieval, use, transmission, anonymisation, blocking, erasure, or destruction.

UK GDPR – the General Data Protection Regulation (Regulation (EU) 2016/679) as incorporated into and applicable under the laws of the United Kingdom.

Organiser – Next Generation IT Solutions Limited, a company registered at No. 3 Tai Yau Street, San Po Kong, Kowloon, Hong Kong, registration number 2911055, acting as the data controller within the meaning of the UK GDPR.

Participant – the data subject, being the natural person whose Personal Data is processed.

Third Parties – external companies or individuals that process Personal Data on behalf of the Organiser, including, but not limited to, technical service providers, marketing agencies, photography and videography contractors, as well as legal and financial advisers.

All other terms used in this Privacy Policy shall have the meanings defined in the Rules of the 1xAffiliates London Select Activation.

2. INTRODUCTION

  • 2.1. The Organiser conducts the 1xAffiliates London Select Activation (the Activation) and has adopted this Privacy Policy (the Policy) to help Participants understand how the Organiser collects, uses, and protects Participants’ Personal Data.
  • 2.2. By completing the registration form, the Participant acknowledges and consents to the processing of their Personal Data, including its collection, storage, and transfer, in accordance with this Policy.
  • 2.3. If a Participant does not agree with the terms of this Policy, they must refrain from participating in the Activation.
  • 2.4. The Participant has the right to revoke their consent to the processing of Personal Data at any time by notifying the Organiser at: [email protected]. As the processing of Personal Data is necessary for the administration and operation of the Activation, withdrawal of such consent will make further participation impossible and shall be deemed a withdrawal from participation in the Activation. Withdrawal of consent shall not affect the lawfulness of any processing carried out prior to its receipt.

3. COLLECTION OF PERSONAL DATA

  • 3.1. The Organiser collects the following Personal Data from Participants:
  • – name;
  • – company name (optional);
  • – Telegram username and/or email address;
  • – geography (GEO) / country;
  • – traffic type;
  • – approximate traffic volume;
  • – photographs and/or video recordings taken at the Booth during the Activation.
  • 3.2. Personal Data is collected during:
  • – personal conversations with a Manager;
  • – completion of the registration form;
  • – the conduct of the Grand Draw (photography/video recording).
  • 3.3. The Organiser does not collect special category Personal Data, such as information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, criminal convictions or offences, health data, sex life, biometric data, or genetic data.

4. PROCESSING OF PERSONAL DATA

  • 4.1. Personal Data is processed by the Organiser and by authorised persons acting on behalf of the Organiser, including:
  • the Activation administration team;
  • the technical support team;
  • data analytics specialists.
  • 4.2. Personal Data is processed for the purposes of administering and conducting the Activation, in particular for:
  • – verifying eligibility to participate and registering the Participant within the Organiser’s internal systems;
  • – communicating with the Participant in connection with the Activation;
  • – conducting the Grand Draw and determining winners;
  • – awarding prizes;
  • – subsequent business communications following the event (subject to the Participant’s separate consent);
  • – publishing the results of the Activation through the Organiser’s official channels;
  • – marketing communications and newsletters (subject to the Participant’s separate consent).
  • 4.3. Solely for the purposes of administering and conducting the Activation, the Organiser may disclose Personal Data to Third Parties, including:
  • – hosting and technical service providers;
  • – email marketing service providers;
  • – photography and videography contractors engaged to document the Grand Draw;
  • – legal and compliance advisers assisting with the administration of the Activation.
  • 4.4. Personal Data may be transferred to and processed outside the United Kingdom. In such cases, the Organiser shall take measures to ensure an adequate level of protection for Personal Data in accordance with applicable law.

5. STORAGE OF PERSONAL DATA

  • 5.1. The Organiser stores Personal Data for the period necessary to:
  • – conduct the Activation;
  • – comply with the Organiser’s legal obligations and resolve disputes;
  • – maintain records for auditing and business purposes.
  • 5.2. The Organiser retains Personal Data for the period necessary to achieve the processing purposes specified in this Policy, but for no longer than 3 (three) years from the completion of the Activation, or until consent is withdrawn, in the case of data processed on the basis of such consent.
  • 5.3. After this period expires, the Organiser deletes the Personal Data from its databases.

6. SECURITY

  • 6.1. The Organiser guarantees that:
  • – only those employees and authorised persons who require access to Participants’ Personal Data for the administration and conduct of the Activation are granted such access;
  • – such employees and authorised persons are bound by confidentiality obligations regarding Personal Data;
  • – the Organiser has implemented appropriate security policies, rules, and technical measures to protect Personal Data against unauthorised access, improper use or disclosure, unauthorised modification, unlawful destruction, or accidental loss;
  • – Third Parties to whom Personal Data may be transferred are required to process such data solely on the Organiser’s instructions, comply with applicable data protection laws, and ensure the confidentiality of the information received.

7. LEGAL BASIS FOR PROCESSING (UK GDPR)

  • 7.1. The Organiser processes Personal Data on the following legal bases:
  • – Consent (Article 6(1)(a) UK GDPR) – for marketing communications, subsequent business communications, and the use of photo and video materials;
  • – Performance of a contract or steps prior to entering into a contract (Article 6(1)(b) UK GDPR) – for the purposes of conducting the Activation and awarding prizes.

8. PARTICIPANT RIGHTS

  • 8.1. In accordance with applicable data protection legislation (including the UK GDPR), the Participant has the right to:
  • – access their Personal Data;
  • – rectify inaccurate or incomplete information;
  • – request the erasure of their Personal Data (which will result in termination of participation in the Activation);
  • – restrict processing;
  • – data portability;
  • – object to processing;
  • – withdraw consent to the collection, processing, and storage of Personal Data (which will result in termination of participation in the Activation).

8.2. In the event of a violation of their rights, the Participant may lodge a complaint with the Information Commissioner’s Office (ico.org.uk).

9. PROTECTION OF MINORS

  • 9.1. The Organiser does not knowingly collect Personal Data from minors. The Activation is intended for individuals who are at least 25 years of age. By providing their data to the Organiser, the Participant represents and warrants that they are 25 years of age or older. If the Organiser becomes aware that a minor has participated in the Activation, the Organiser reserves the right to disqualify such Participant and delete their Personal Data.

10. THIRD-PARTY SOURCES

  • 10.1. The QR code on the Ticket and other Activation materials may contain links to third-party websites. These websites are not controlled, operated, or maintained by the Organiser. This Policy does not apply to third-party websites.

11. FINAL PROVISIONS

  • 11.1. The Organiser reserves the right to amend or supplement this Policy at any time at its sole discretion.
  • 11.2. Continued participation in the Activation after any amendments to the Policy have been made constitutes the Participant’s acceptance of such amendments.
